Please read these Terms and Conditions carefully before using the www.MyAED.com website (the “Service”) operated by MyAED (“us”, “we”, or “our”).
By purchasing products packaged for Medical Professional Use Only, I acknowledge and certify that I am a trained medical professional authorized by Federal, State, and/or Local policies, rules, regulations, guidelines, protocols, and/or laws to purchase and use this product. MyAED assumes no liability for its misuse.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
Purchases
If you wish to purchase any product or service made available through the Service, you may be asked to supply certain information including your name, date of birth, address, shipping address, and payment information. We accept Visa, Mastercard, American Express, and Discover. ACH/bank account payments are also accepted through our payment processor. You may save payment methods to your account for faster checkout.
Saved Payment Methods
You may save payment methods to your account for faster checkout. Saved payment methods are stored securely by our payment processor and are not retained on MyAED’s servers in full. You may add, update, or remove saved payment methods at any time from your account dashboard. MyAED is not responsible for unauthorized use of a saved payment method resulting from your failure to protect your account credentials.
Custom Orders and Quotes
For bulk orders or products requiring custom pricing, you may submit a quote request at store.myaed.com/quote. Quotes are valid for 30 days from the date of issue unless otherwise stated. An accepted quote converts to a binding order subject to these Terms and Conditions. MyAED reserves the right to decline any quote request.
Product Reviews
By submitting a product review, you grant MyAED a non-exclusive, royalty-free license to display your review on our website and in related marketing materials. All reviews are subject to moderation and approval before publishing. MyAED reserves the right to decline or remove any review that violates our content standards, contains false information, or is submitted in bad faith.
Circumstances Beyond MyAED’s Reasonable Control
MyAED will make every effort to perform our obligations under the contract. However, MyAED cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control, including supplier delays, carrier disruptions, natural disasters, or governmental restrictions. In the event of a delay, MyAED will perform our obligations as soon as reasonably possible.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Warranty
Products carry only those warranties provided by their manufacturers. MyAED offers no additional warranties relating to products. Warranties do not apply to abuse, accident, acts of God, consumable parts, accessories, improper installation or operation, and/or normal wear and tear.
EXCEPT AS SET FORTH HEREIN, THERE ARE NO OTHER EXPRESSED OR IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. COMPANY’S SOLE OBLIGATION AND CUSTOMER’S EXCLUSIVE REMEDY FOR BREACH OF ANY WARRANTY SHALL BE, AT COMPANY’S OPTION, TO REPAIR OR REPLACE THE PRODUCT. COMPANY SHALL NOT BE LIABLE FOR ANY OTHER DAMAGES INCLUDING, BUT NOT LIMITED TO, INDIRECT, INCIDENTAL, CONSEQUENTIAL, LOST PROFITS, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES REGARDLESS OF THE FORM OF THE ACTION OR THE THEORY OF RECOVERY, EVEN IF THAT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

Dispute Resolution & Arbitration Agreement
Scope. Both you and MyAED agree that any legal dispute arising out of a purchase from MyAED’s website, your enrollment in any program or service, or any communications between you and MyAED shall be resolved through binding individual arbitration unless you opt out as described below. You waive your right to sue or go to court to assert or defend your rights. Either party may bring individual claims in small claims court.
Informal Dispute Resolution. Either party asserting a dispute shall first try in good faith to resolve it by providing written notice describing the facts and circumstances, allowing the receiving party 30 days to respond. Notice to MyAED shall be sent by email to [email protected]. This procedure is a condition precedent to initiating arbitration.
Right to Opt Out. You may opt out within the first 30 days after making a purchase from our website or signing up for any program or service. To opt out, send a written request to [email protected] with your full name, mailing address, and the words “Reject Arbitration.”
How Arbitration Works. Arbitration shall be conducted by the American Arbitration Association (“AAA”) pursuant to its Consumer Arbitration Rules, available at www.adr.org or by calling (800) 778-7879. Arbitration hearings will take place in the county of your residence. If you live outside the United States, arbitration will take place in Palm Beach County, Florida, USA.
Waiver of Class Action. All arbitrations shall proceed on an individual basis. You and MyAED each waive the right to a trial by jury and to participate in any class action lawsuit, class action arbitration, or joint/consolidated arbitration of any kind.
Governing Law. This Arbitration Agreement is governed by the Federal Arbitration Act and applicable federal law. To the extent state law applies, the law of your state of residence (as determined by your mailing address on file) will govern.
Unenforceable Provisions
If any provision of this website disclaimer is found to be unenforceable under applicable law, that will not affect the enforceability of the other provisions.
